§ 1. General Provisions
1. These Terms and Conditions govern the use of the website available at trzebachleba.pl (hereinafter: Service) and the rules for placing and fulfilling online orders.
2. The owner and operator of the Service is the bakery Trzeba Chleba located at ul. Wojewodzka 36/38, 40-026 Katowice, Poland.
3. These Terms apply exclusively to services provided through the website.
4. Using the Service constitutes acceptance of these Terms and Conditions.
5. These Terms are made available free of charge on the website in a form that allows downloading, saving, and printing.
§ 2. Definitions
Service - the website available at trzebachleba.pl enabling online ordering.
User - a natural person using the Service.
Account - an individual User account in the Service, created during registration.
Order - a User's declaration submitted through the Service, aimed at concluding a sales contract for bakery products.
Business day - a day on which the bakery is open according to the schedule available in the Service.
§ 3. Placing Orders
1. Orders may be placed through the Service 24 hours a day, subject to point 2.
2. Orders for a given business day can be placed until the bakery opens on that day. After opening, orders can only be placed for subsequent days.
3. Placing an order requires providing a phone number, which is used to identify the order at pickup.
4. Placing an order does not require Account registration.
5. Product availability is updated in real-time. The bakery reserves the right to refuse order fulfillment if a product is unavailable.
6. Order confirmation is sent only to Users with an Account linked to a phone number.
§ 4. Bakery's Right to Cancel Orders
1. The bakery reserves the right to cancel an order or individual products due to circumstances beyond its control.
2. Reasons may include: ingredient unavailability, equipment failure, unsuccessful baking, or other circumstances preventing product preparation.
3. In case of cancellation, the bakery will inform the User by phone using the number provided when placing the order.
4. The bakery will make every effort to inform about cancellation as early as possible.
5. Cancelled products are not subject to payment.
§ 5. Order Pickup
1. Orders are fulfilled exclusively through personal pickup at the bakery premises.
2. The bakery does not provide delivery services.
3. Orders can be picked up during bakery working hours. Opening hours are available in the website footer and on the contact page.
4. The bakery guarantees order availability throughout the entire business day scheduled for pickup.
5. When placing an order, Users can specify a preferred pickup time slot. This information is for guidance only.
§ 6. Payments
1. Payment is made exclusively upon pickup at the bakery premises.
2. The bakery accepts cash and card payments.
3. Product prices listed in the Service are gross prices including VAT.
4. Prices may change; however, changes do not apply to orders already placed.
§ 7. User Order Cancellation
1. Users may cancel orders no later than 4 hours before the bakery closes on the scheduled pickup day.
2. Order cancellation is possible through the User Account or by contacting the bakery.
3. After this deadline, order cancellation is not possible.
4. This time limit enables the sale of prepared products and reduces food waste.
§ 8. Unfulfilled Orders
1. Orders not picked up on the scheduled day are recorded in the system.
2. The bakery reserves the right to block ordering capabilities for Users who repeatedly fail to pick up their orders.
3. In case of pickup delays, the bakery may contact the User by phone.
4. Products from unfulfilled orders are not subject to refund or complaint.
§ 9. Pickup Date Changes
1. Changing the pickup date of a placed order is not possible.
2. If a date change is necessary, the User should cancel the order per § 7 and place a new order with the correct date.
§ 10. User Account
1. Account registration is voluntary and free of charge.
2. Having an Account enables: cancelling orders through the Service, access to order history, receiving order confirmations.
3. Users must provide accurate information during registration.
4. Users are responsible for maintaining login credential confidentiality.
5. The bakery reserves the right to block or delete Accounts for Terms violations.
§ 11. Cookies
1. The Service uses session cookies essential for proper website operation.
2. Session cookies are used to: maintain logged-in user sessions, ensure connection security, enable proper shopping cart functionality.
3. Session cookies are automatically deleted when the browser is closed.
4. The Service does not use marketing or analytics cookies.
5. Using the Service constitutes consent to the use of necessary cookies.
§ 12. Complaints
1. Product quality complaints should be submitted on the day of order pickup.
2. Complaints can be submitted in person at the bakery or by email to kontakt@trzebachleba.pl.
3. Complaints should include a description of the issue and contact information.
4. The bakery will process complaints within 14 days of receipt.
5. If upheld, the bakery will replace the product or refund its value.
§ 13. Personal Data Protection
1. The data controller is the bakery owner.
2. Personal data is processed for order fulfillment and Account services.
3. Detailed information is contained in the Privacy Policy available in the Service.
4. Providing a phone number is necessary for order identification and pickup.
5. Personal data is not shared with third parties without consent, except as required by law.
§ 14. Final Provisions
1. These Terms take effect on the date of publication in the Service.
2. The bakery reserves the right to modify these Terms.
3. Users will be notified of significant changes through a notice in the Service.
4. Changes do not affect orders placed before they take effect.
5. Matters not regulated are governed by Polish law.
6. Disputes will be resolved by the court having jurisdiction over the bakery's registered office.
§ 15. Newsletter
1. Users may subscribe to the bakery's newsletter by providing their email address in the form available in the Service footer.
2. The newsletter contains information about news, new products, and bakery promotions.
3. Subscribing to the newsletter is voluntary and free of charge.
4. Users may unsubscribe from the newsletter at any time by clicking the "Unsubscribe" link included in every newsletter email.
5. The email address provided during subscription is processed solely for newsletter delivery.
6. The newsletter is sent exclusively in Polish.
